Terms of Service

These terms are the rules for using Couch. They're written to be readable, not to trick you. How we handle your data is explained in our Privacy Policy.

1. Who Provides Couch

Couch is run by Hemendra Khatik, an individual based in India. It isn't a company. When these terms say "we" or "us", they mean Hemendra Khatik. You can reach Hemendra at [email protected].

2. Agreeing to These Terms

By using Couch, you agree to these terms. If you don't agree, please don't use it.

Couch is for adults

You must be 18 or older to use Couch. You confirm this once, when you start, and we keep a record of that confirmation and the version of these terms you agreed to.

3. What Couch Is

Couch is a browser-based private video room for exactly two people. Someone who opens your room link knocks, and only gets in when you let them. Inside, you can video call, share your screen to watch things together, chat, react, play games, keep a shared list of Little things, capture Moments and use face filters. You can join from desktop, tablet or phone; sharing a screen needs a desktop browser.

Couch is free right now. We may add paid features later. If we do, we'll tell you clearly before anything costs money, and you'll never be charged without agreeing to it first.

4. Your Account

You sign in to Couch with a Google account. You're responsible for keeping that account secure and for what happens on Couch under it. You can only have one active session in a room at a time: opening the same room in another tab closes the earlier one.

5. Using Couch Respectfully

Please don't use Couch to:

There's always another person in your room, so respect them. Get their OK before you capture or share a Moment of them, and before recording the call in any way. Spicy levels in games need both people to agree before they start.

You're responsible for everything you share — your camera, audio, screen, messages and notes.

We have zero tolerance for objectionable content and abusive people. If you break these rules, we may remove you from Couch without warning.

6. Watching Together & Copyright

Screen sharing on Couch is for private watching with the one other person in your room. When you share something from a streaming service, you're responsible for following that service's terms. Many of them limit sharing outside your household.

Couch isn't affiliated with, or endorsed by, any streaming service.

7. Your Content

You own everything you share. Calls are encrypted end to end and never recorded, and we don't access your video, audio or screen. For things Couch passes along or keeps for you, like chat messages and room names, you give us only the permission we need to deliver and store them for you, and nothing more.

8. Reporting Problems & Takedowns

If someone breaks these terms, report them: in the app, open More in the room and choose "Report or block"; on the web, use "Report a problem" inside the room. You can also email [email protected]. Copyright notices go to the same address: tell us what the work is, where it appeared on Couch, and how to reach you.

You can block anyone you've been in a room with. Once blocked, neither of you can join a room the other is in or created, and we take them out of the room you're sharing. We don't tell them. You can unblock people in Settings.

We look at every report, within 24 hours. Where it's needed, we act, including removing content we store or removing someone's access to Couch.

9. Third-Party Services

Couch relies on other services, such as Google for sign-in and storage, and hosting providers for our servers. Their own terms apply to them, and we're not responsible for their availability. We're also not responsible for content you access through your browser while using Couch, like the streaming services you watch.

10. Suspension & Ending

We may suspend or remove your access if you break these terms, or if we need to protect someone's safety or follow the law. You can stop using Couch whenever you want. To delete your account, email [email protected] and we'll handle it as described in our Privacy Policy.

11. No Warranties

Couch is provided as-is. We don't guarantee the service will always be available, that calls will always connect, or that call quality will meet any particular standard.

12. Limitation of Liability

To the extent the law allows, we're not liable for indirect or unexpected losses from your use of Couch. The service is free, and our liability is limited accordingly. Nothing in these terms limits rights you have as a consumer that the law says can't be waived.

13. Indemnity

If someone makes a claim against us because of something you shared on Couch or because you broke these terms, you agree to cover the reasonable costs that result, to the extent the law allows.

14. Governing Law & Disputes

These terms are governed by the laws of India, and disputes go to the courts of India. If you're a consumer in the EU, the UK or elsewhere, you keep the protections of your local law and can bring a claim in your local courts. Before going to court, please email us first, so we can try to sort it out together.

15. Grievance Officer

Under India's IT Rules 2021, our Grievance Officer is Hemendra Khatik, reachable at [email protected]. We acknowledge complaints within 24 hours and aim to resolve them within 15 days.

16. Changes

We may update these terms. When we do, the date at the top of this page will change. If the change is significant, we'll also let you know in the app or by email. Continued use means you accept the updated terms.
